AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING; THE FOUNTAIN HILLS TOWN
CODE, CHAPTER 8, RELATING TO REGULATION OF SPECIAL EVENTS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1. That certain document known as the "Town of Fountain Hills Special Event
Regulations" dated November 3, 2011 (the "Special Event Regulations "), three copies of which are
on file in the office of the Town Clerk, which document was made a public record by Resolution No.
2011 -43 of the Town of Fountain Hills, Arizona, is hereby referred to, adopted and made a part
hereof as if fully set out in this Ordinance.
SECTION 2. The Fountain Hills Town Code, Chapter 8, Business Regulations, Article 8 -1
Special Events, is hereby deleted in its entirety and replaced by the Special Event Regulations, which
shall be inserted into the f=ountain Hills Town Code, Chapter 8, as a new Article 8 -3, Special Events.
SECTION 3. Any person found guilty of violating any provision of the Special Event
Regulations shall be guilty of a class one misdemeanor, punishable by a fine in all amount not to
exceed 52,500.00 or by imprisonment for a period not to exceed six months, or by both such fine and
imprisonment. Each day that a violation continues shall be a separate offense punishable as
described above.
SECTION 4. I1'any section, subsection, sentence, clause, phrase or portion of this Ordinance
or any part of the Special Event Regulations adopted herein by reference is for any reason to be held
invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions thereof.
SECTION S. Tile Mayor, the Town Manager, the Town Clerk and the Town Attorney are
hereby authorized and directed to execute all d0Ct11174ntS and take all steps necessary to carry out the
purpose and intent of'this Ordinance.

November 3, 2011.
