A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, TERMINATING AN INTERGOVERNMENTAL
AGREEMENT WITH MARICOPA COUNTY FOR SPECIAL
TRANSPORTATION SERVICES.
WHEREAS, on May 17, 2007, the Council of the Town of Fountain Hills (the "Town
Council ") adopted Resolution 2007 -16, approving an Intergovernmental Agreement for Special
Transportation Services with Maricopa County to provide special transportation services for
senior citizens and handicapped individuals (the "IGA "), and on June 21, 2007, the Town
Council adopted Resolution 2007 -31, approving an Amendment to the IGA; and
WHEREAS, on April 29, 2009, Maricopa County provided the Town with written notice
of Maricopa County's intention to terminate the IGA, effective June 30, 2009, a copy of which
notice of termination is attached hereto as Exhibit A and incorporated by reference.
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1. That the recitals set forth above are hereby incorporated as if (filly set
forth herein.
SECTION 2. That the Intergovernmental Agreement relating to funding for special
transportation services for senior citizens and handicapped individuals approved by the Town
Council pursuant to Resolution 2007 -16, and as amended pursuant to Resolution 2007 -31, is
hereby tenninated.
SECTION 3. That the Mayor, the Town Manager, the Town Clerk and the Town
Attorney are hereby authorized and directed to take all steps to terminate the IGA pursuant to its
terms and to carry out the purpose and intent of this Resolution.
PASSED AND ADOPTED by the Mayor and Council of the Town of Fountain Hills,
Arizona, June 4, 2009.

Dear Ms. Ghetti,
On April 13, 2009 the Maricopa County Board of Supervisors directed the Office of
Management and Budget to include annualized impact of the FY 2008 -2009 expenditure and
revenue adjustments, along with other expenditure adjustments in FY 2009 —10 recommended
budget. The anticipated reduction in funding would result in the elimination of the Special
Transportation Services Program.
Per provision of the Intergovernmental Agreement gGA) with Maricopa County, executed on
February 21, 2007, we are providing you with notice of termination of this IGA. The
termination will be effective June 30, 2009. A formal acknowledgement will be sent from the
Maricopa County Board of Supervisors from the May 6, 2009 meeting.
